§ 1 Provider and scope

Kryst is a service provided by DMNT Studio, owner Stefan Rohrbach, c/o Online-Impressum 10950, Europaring 90, 53757 Sankt Augustin, Germany, email: dmnt-studio@mail.online-impressum.de (“we”).

These terms apply to everyone who sets up Kryst on a Discord server (server operators) and to everyone who uses the bot on a server (users). By inviting or using the bot, you accept these terms.

§ 2 What Kryst provides

Kryst is a Discord bot with a core (setup, settings, help) and modules that can be enabled individually, for example for events. The available functions are listed on this website and in the bot under /kryst-hilfe.

Kryst is currently free of charge. Free use may be subject to limits, for example on the number of events or channels. The bot shows the current limits.

We continue to develop Kryst. Functions may be added, changed or removed. Free use does not give rise to a claim to specific functions.

§ 3 Requirements

• Use requires a Discord account. Discord's terms and policies also apply.
• Only persons with the necessary permissions on the server may set up the bot.
• Kryst is an independent service and is not affiliated with Discord Inc.

§ 4 Obligations of server operators

The server operator

• concludes the data processing agreement during setup with /setup and is responsible under data protection law for the data of their members,
• informs their members that the bot is running on the server and which functions are active,
• uses the bot only in accordance with the law and Discord's policies,
• provides a channel during /setup through which we can reach them in the event of outages or data protection incidents.

§ 5 Prohibited use

• using the bot for spam, harassment, fraud or other unlawful purposes,
• deliberately overloading or attacking the bot or our servers or exploiting security vulnerabilities,
• technically circumventing the limits of free use,
• imitating the bot or acting as if on our behalf.

§ 6 Availability and support

Kryst is operated with care, but as a side business. We strive for uninterrupted operation but do not guarantee any particular availability. Maintenance, updates and outages at Discord or at the hosting provider may cause downtime.

Support is available in the support channel on our Discord server and by email. We usually reply within 48 hours. There is no 24/7 support and no individual customisation for single servers.

§ 7 Suspension

If a server or user violates these terms, we may suspend the bot for that server or user in whole or in part. Where reasonable, we will give prior notice via the channel provided during /setup. In the event of serious violations or danger to others, we suspend immediately.

§ 8 Term and termination

The server operator can stop using the service at any time by removing the bot from the server. The data will then be deleted in accordance with our privacy policy.

We may end free use with 30 days' notice or discontinue the service entirely. We will announce this on this website and in the support channel. The right to suspend under § 7 remains unaffected.

§ 9 Liability

For free use, we are liable only for intent and gross negligence. We are liable without limitation for injury to life, body or health, under the German Product Liability Act and where we have fraudulently concealed a defect.

Users are responsible for content they create or distribute via the bot. We are not liable for outages or changes at Discord.

§ 10 Data protection

How we handle data is described in the privacy policy and in the data processing agreement.

§ 11 Changes to these terms

We may change these terms for the future, for example when new functions or paid tiers are added or the legal situation changes. We will announce material changes at least 30 days in advance on this website and in the support channel. Anyone who does not agree with a change can remove the bot at any time. Paid services are only booked if the server operator expressly agrees.

§ 12 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protective provisions of the state in which they have their habitual residence. Should any provision be invalid, the remaining provisions remain valid.
